Tribal Council Meeting – January 8, 2020, 5:00 PM

  1. Meeting called to order at 5:16 p.m.
  2. Roll Call

Presiding Officer:  Dawson Davenport, Chairman

Tribal Council present:  Drayton Roberts, Vice-Chairman; Delonda Pushetonequa, Treasurer; Zane Oldbear; Clinton Bear, Jarvis Bear; Eric Kapayou.

Staff present: Tamara Mauskemo, Tribal Council Secretary.

  1. Ascertainment of Quorum – A quorum was ascertained with 7 council members present.
  2. Agenda approval-

The Chairman asked for agenda approval. Motion made by Delonda Pushetonequa to approve the agenda. Drayton Roberts seconded. Vote: 6 yes, 0 no. Motion carried.

  1. Minutes-November 22, 2019 and November 26, 2019.

Motion made by Drayton Roberts to approve the minutes for November 22, 2019 and November 26, 2019.  Clinton Bear seconded. Vote: 6 yes, 0 no. Motion carried.

  1. Old Business-Adrian Mauskemo-Issiah Roberts Enrollment Reinstatement

Adrian Mauskemo presented a request for reinstatement for Issiah Roberts.

Motion made by Jarvis Bear to table Issiah Roberts request until Enrollment has reviewed all the documents.  Delonda Pushetonequa seconded. Vote: 6 yes, 0 no. Motion carried.

  1. New Business
    1. Appoint Election Committee-Leigh Lasley and Alexis Walker

Motion by Drayton Roberts to elect Leigh Lasley and Alexis Walker to the Election Committee.  Jarvis Bear Seconded.  Vote: 6 yes, 0 no.  Motion carried. 

  1. Lysette Wanatee-Enrollment Reinstatement Request

Not present

  1. Nolan Blackcloud-Enrollment Reinstatement Request

Nolan Blackcloud and Alexa, mother, presented request for reinstatement for enrollment and presents all required paperwork.

Motion by Delonda Pushetonequa to reinstate enrollment for Nolan Blackcloud.  Drayton Roberts seconded.  Vote: 6 yes, 0 no.  Motion carried. 

  1. Amanda Davenport-Research Study Approval

Amanda Davenport requests a letter of approval for a language research study to be with Meskwaki Settlement School staff.

Motion by Jarvis Bear to approve the language research study letter of approval to be signed by Chairman.   Dalton Roberts seconded. Vote: 6 yes, 0 no. Motion carried.

  1. Lauryn Keahna-Tabled housing decision

Discussion on housing decision.

Motion by Jarvis Bear to table housing decision until further discussion of the Housing Policies.   Drayton Roberts seconded. Vote: 6 yes, 0 no. Motion carried.

  1. Enrollment-Applicants

The Enrollment Committee held a meeting on December 17, 2019 and passed a motion recommending Tribal Council approval of two (2) applications for membership to the Sac and Fox Tribe of the Mississippi in Iowa.

Motion by Jarvis Bear to approve the enrollment of Raiden Lee Wanatee and Memphis Rainn Youngbear. Delonda Pushetonequa seconded. Vote: 6 yes, 0 no . Motion carried.

  1. MNPD-Media Request

Yolanda Pushetonequa presented and made an announcement of the petitions to recall Dawson Davenport and Eric Kapayou.

  1. Fiscal-Resolution for Rec Center Modification of estimated cost & Ordinance to dissolve Housing Authority.

Bill Thurman, Comptroller, presented Resolution 1-2020 to authorize on a recreational center and authorizing tribal funds towards its construction not to exceed twenty-five million dollars.  Grants will also be submitted by the Tribe to off-set the cost.

Motion by Jarvis Bear to approve Resolution 1-2020.  Delonda Pushetonequa seconded. Vote: 5 yes, 1 no . Motion carried.

Bill Thurman, Comptroller, presented Resolution 2-2020 to dissolve the Sac & Fox Housing Authority as it is no longer necessary and that it will otherwise manage and oversee the operations of the Sac & Fox Housing Authority.  A tribal ordinance was also presented that needs approval.

Motion by Jarvis Bear to dissolve the Sac & Fox Housing Authority Resolution 2-2020.  Delonda Pushetonequa seconded. Vote: 5 yes, 1 no . Motion carried.

  1. Housing Committee Recommendations

Jon Keen presents support and approval of Housing Committee recommendations.

Motion by Jarvis Bear to set up Housing Committee meeting as soon as possible with Housing Committee, Housing Director, Realty and Tribal Council.  Drayton Roberts seconded. Vote: 6 yes, 0 no . Motion carried.

  1. Human Resources-Subrogation Inquiry/Legal-Auxiant Litigation

Motion by Jarvis Bear to go into Executive Session.  Drayton Roberts seconded.  Vote: 6 yes, 0 no.  Motion carried.  Meeting went into executive session at 7:24 pm.  Motion by Jarvis Bear to come out of Executive Session.  Drayton Roberts seconded. Vote: 6 yes, 0 no.  Motion carried.  Out of Executive session at 7:36 pm.

Jay Finch presented decision on subrogation inquiry.

Motion by Jarvis Bear to approve the UMR settlement of $17,121.24.  Drayton Roberts seconded. Vote: 6 yes, 0 no . Motion carried.

Jay Finch presents a motion to authorize the Chairman to sign a permanent exclusion order for Aaron Dolash.

Motion by Jarvis Bear to approve the Chairman to sign the permanent exclusion order on Aaron Dolash.  Clinton Bear seconded. Vote: 6 yes, 0 no . Motion carried.

Motion by Jarvis Bear to have media post pictures of excluded individuals.  Clinton Bear seconded. Vote: 6 yes, 0 no . Motion carried.

  1. MBCH-Approve scope of work for North Tower-No Show

Motion by Jarvis Bear to table Meskwaki Bingo Casino Hotel.  Drayton Roberts seconded. Vote: 6 yes, 0 no . Motion carried.

  1. Legal-Auxiant Litigation (presented with HR item)

Report from Chairman- MBCH next tower renovations will be carefully monitored and sports betting discussed.
