Tribal Council Meeting – August 28, 2019, 5:00 PM

  1. Meeting called to order at 5:00 p.m.
  2. Roll Call

Presiding Officer:  Anthony Waseskuk, Chairman

Tribal Council present:  Delonda Pushetonequa, Treasurer; Troy Wanatee, Jarvis Bear; Dawson Davenport Apollo Davenport entered the meeting at 5:01 p.m.

Staff present:  Jay Finch, Attorney General; Lowella Balderas, Interim Tribal Council Secretary

Visitors:  Summer Johnson; Yvondra Buffalo; Nader Buffalo; Lucy One Star; Bev Roberts; Kerwin Davenport; Rae J Lasley, Steadman Brown.

  1. Ascertainment of Quorum – A quorum was ascertained with 6 council members present.
  2. Agenda approval

The Chairman asked for any changes or additions to the agenda. Delonda Pushetonequa requests to remove Item 8a and set for a later date.

Motion made by Delonda Pushetonequa to approve the agenda with changes. Dawson Davenport seconded. Vote: 5 yes, 0 no. Motion carried.

Motion made by Delonda Pushetonequa  to approve the minutes for August 14, 2019. Apollo Davenport seconded. Vote: 5 yes, 0 no. Motion carried.

  1. MSS-Waiver Requests

Summer Johnson presents a waiver request for exemption for her child to attend Meskwaki Settlement School.

Motion by Apollo Davenport to approve waiver request for Summer Johnson. Delonda Pushetonequa seconded. Vote: 3 yes, 1 no, 1 abstained, Troy Wanatee. Motion carried.

Lucy One Star presents a waiver request for exemption for her child to attend Meskwaki Settlement School.

Motion by Delonda Pushetonequa to approve waiver request for Lucy One Star. Dawson Davenport seconded. Vote: 3 yes, 1 no, 1 abstained, Troy Wanatee. Motion carried.

Nader & Yvondra Buffalo presents a waiver request for exemption for their child to attend Meskwaki Settlement School.

Motion by Apollo Davenport to approve waiver request for Nader & Yvondra Buffalo. Dawson Davenport seconded. Vote: 4 yes, 1 no. Motion carried.

  1. Housing- Recommendations

Jon Keen from Realty presented Kane Youngbear as assignee to 222 Deerfield Crossing as Beneficiary and Lyle Davenport as caretaker.

Motion by Jarvis Bear to approve Lyle Davenport as caretaker for Kane Youngbear. Dawson Davenport seconded. Vote: 5 yes, o no. Motion carried.

Jon Keen presented housing for Kerwin Davenport to assign home site at 209 West Village Road.

Motion by Delonda Pushetonequa to approve Kerwin Davenport to 209 West Village Road. Troy Wanatee seconded. Vote: 4 yes, 1 no. Motion carried.

Jon Keen presented changes to the Meskwaki Housing Program Policies & Procedures Manual.

Sec. 3-6. Specific Requirements for Beneficiaries and Caretakers.  (b) A beneficiary must be eligible for a homesite assignment under the Property Code and under the Meskwaki Housing Program Polices & Procedures Manual.  Beneficiaries aged 18 and over must undergo the Tribal Access Program and Tribal Court Records background checks.

Motion by Jarvis Bear to approve the changes of the Housing Program Policies & Procedures. Delonda Pushetonequa seconded. Vote: 5 yes, 0 no. Motion carried.

  1. MSS-Staff Handbook Approval

Willie Barney presented the Meskwaki Settlement School Staff Handbook.  Discussion and questions on the wording on the handbook.

Motion by Delonda Pushetonequa to approve the 2019-2020 Meskwaki Settlement School Staff Handbook with changes. Jarvis Bear seconded. Vote: 5 yes, 0 no. Motion carried.

Motion by Delonda Pushetonequa to go into Executive Session.  Dawson Davenport seconded.  Vote: 5 yes, 0 no.  Motion carried.  Meeting went into Executive Session at 6:03 p.m.  Motion by Jarvis Bear to come out of Executive Session.  Dawson Davenport seconded.  Vote: 5 yes, 0 no.  Motion carried.  Out of Executive Session at 6:15 p.m.

  1. Enrollment

Lucie Roberts presented Enrollment Applicants (6).

Motion by Apollo Davenport to approve the enrollments of Daren Michael Back, Jade MarieLinn Back, Della Jo Bear, Randolph Eugene Bear, Issac Richard Joe Johnson, Maxwell Liam Wanatee. Jarvis Bear seconded. Vote: 5 yes, 0 no. Motion carried.

  1. Attorney General Matters

Jay Finch presented Resolutions 19-2019 to add Sec. 8-2105 “School Board Elections” to Title 8, Article II, Chapter 1 of the Elections and Petitions code.  Resolution 20-2019 to add Sec. 13-5909 entitled “Trespass after Exclusion or Banishment” to Title 13, Article V, Chapter 9 of the Law and Order Code for approval.

Motion by Jarvis Bear to approve Resolution 19-2019. Delonda Pushetonequa seconded. Vote: 5 yes, 0 no. Motion carried.

Motion by Jarvis Bear to approve Resolution 20-2019 . Dawson Davenport seconded. Vote: 5 yes, 0 no. Motion carried.

Discussion took place regarding School Board Elections and to schedule work session with Election Committee next week September 3, 2019 at 7 p.m.

  1. MBCH-Contract/Resolution Approval

Jay Finch presented the Master Agreement Bally Gaming/Scientific Game contract/resolution for approval.

Motion by Jarvis Bear to approve Resolution 21-2019. Dawson Davenport seconded. Vote: 5 yes, 0 no. Motion carried.

Discussion on Meskwaki Bingo Casino Hotel issues and Tribal Council makes a directive to meet with Jon Papakee and Dirk Whitebreast in a work session for Tuesday September 3, 2019 at 4:30 p.m.
