- Ascertainment of Quorum – A quorum was ascertained with 6 council members present.
- Agenda approval
The Chairman asked for any changes or additions to the agenda. Motion made by Delonda Pushetonequa to approve the agenda as presented. Harvey Davenport seconded. Vote: 5 yes, 0 no. Motion carried.
- Minutes –
Motion made by Apollo Davenport to approve the minutes for May 18, 2018 and June 13, 2018. Delonda Pushetonequa seconded. Vote: 5 yes, 0 no. Motion carried.
- Reports –
- Health – Apollo Davenport presents a packet describing the Indian Behavioral Health Initiative, defining behavioral health, and outlining the program. He also provides a report of recent Health Liaison activity in June and July including a visit from the Region 7 Area US DHHS with the council and staff, a work session with health director, a meeting with Shakopee Health Department, attendance at the BIA Partners in Action Conference in WI, and the Indian Behavioral Health Conference in DC.
- Old Business –
- Senior Services – Senior Trip
Nicole Davenport, Senior Services Director, presents a tour package from Elite Tours. It’s a less costly alternative to the previous plan presented at the last meeting, has more appropriate number of stops, and seems to have more relevant stops. It has one over night stop on the way to Niagara as opposed 5 with the other alternative; and staying in Niagara for 5 days; and then return home with one stop. The cost is $27,909. Motion by Jarvis Bear to approve the Senior Trip as presented today using Elite Tours. Delonda Pushetonequa seconded. Vote: 5 yes, 0 no. Motion carried.
- Blue Stone Strategy Group – Approval of Additional Expenses and Project Update
Bessie Scott presents a document outlining Blue Stone’s Project update and their request for approval of two additional trips. The costs of recent trips are discussed.
Apollo Davenport makes a motion to approve additional expenses by Blue Stone Strategy Group to travel to Tama for two more on-site visits. Jarvis Bear seconded. Vote: 5 yes, 0 no. Motion carried.

- Tribal Member Requests – Allison Stewart request
Allison is not present today.
Jarvis Bear makes the motion to table Allison Stewart’s tribal member request. Adrian Pushetonequa seconded. Vote: 5 yes, 0 no. Motion carried.
- Human Resources –
- Appointment of Gaming Commissioner and Start Date
Motion by Delonda Pushetonequa to appoint JoAnn Youngbear to the Gaming Commission with the start date of August 13, 2018. Jarvis Bear seconded. Vote: 5 yes, 0 no. Motion carried.
NIGC Training – August 14-16, 2018.
Motion by Delonda Pushetonequa to send JoAnn Youngbear to attend the NIGC DC Regional Training in Niagara Falls, NY on August 14, 2018 and allow for a delegation of Tribal Council to attend and any other Sac and Fox Gaming Commissioners who wish to attend. Harvey Davenport seconded. Vote: 5 yes, 0 no. Motion carried.
- Exemptions of MSS Staff Contracts regarding school district of choice – No one is in attendance to present anything.
Motion by Jarvis Bear to table this. Adrian Pushetonequa seconded. Vote: 5 yes, 0 no. Motion carried.
- Realty/ Housing –
- Downs Property / Trading of Parcel – Jon Keen presents a request to approve the trading with a land neighbor to trade parcels of land which would make sense for both parties. The lands are relatively equivalent in size and value. Jarvis Bear makes a motion to move forward with initiating the process of trading land parcels with Downs. Adrian Pushetonequa seconded. Vote: 5 yes, 0 no.
- Termination – 2997 F Avenue. Kent Scheid, Housing Director, presents a request for approval of a housing termination of 2997 F Avenue to assignee Brenton Roberts. The home has been vacated for over 2 years, which is a violation of the Constitution and Property Code. There have been enough unauthorized entrances to warrant changing the locks many times. Receipts documenting the number of lock changes are provided. Tribal Council discusses billing the assignee for damages or costs associated with the vacancy. No action taken at this time for billing but will maintain records of the amount owed to the tribe for damages and maintenance and Mr. Roberts will need to pay in full before applying for a new homesite.
Motion by Adrian Pushetonequa to approve the termination of the assignment of 2997 F Avenue seconded. Discussion continues. Adrian Pushetonequa rescinds his motion.

- Disenrollment Hearing Actions
Two hearings were held yesterday, August 1, 2018, regarding the disenrollment of Lyndon Johnson and the disenrollment of Kiedis Oldbear. A quorum of the Tribal Council was present at each hearing. Evidence was presented and both sides were allowed an opportunity to present. The following two motions were made at the hearings (yesterday) on August 1, 2018 as follows:
Motion by Delonda Pushetonequa to approve the disenrollment of Kiedis OldBear based on DNA results, pending whether Kiedis can confirm if he wanted to appear at the hearing. Apollo Davenport seconded. Vote: 6 yes, 0 no, 0 abstained. Motion carried.
Motion by Jarvis Bear to approve the disenrollment of Lyndon Johnson based on DNA results. Harvey Davenport seconded. Vote: 6 yes, 0 no, 0 abstained. Motion carried.
During today’s tribal council meeting (August 2, 2018), the following motion was made to confirm yesterday’s motions made at the August 1, 2018 hearings:
Motion by Delonda Pushetonequa to reaffirm the tribal council decisions and motions made at the two disenrollment hearings yesterday, August 1, 2018. Harvey Davenport seconded. Vote: 5 yes, 0 no. Motion carried.
- Other Items
Bill Thurman, Comptroller, presents a travel suggestion for the Native American Financial Officers Association on September 30 – October 3. The focus is on Tribal Economies. Typically, the tribe sends someone. An agenda for NAFOA is presented.
Motion by Harvey Davenport to approve sending a delegation of Tribal Council and Bill Thurman to NAFOA October 1-2 in Albuquerque. Apollo Davenport seconded. Vote: 5 yes, 0 no. Motion carried.
Apollo Davenport discusses the 35th Annual Behavioral Health conference in Oklahoma City at the Cox Convention Center. He states it’s important for the Tribal Council members to attend to grasp the concept of behavioral health in Indian country. Health Director will not be able to attend this, but Deputy Executive Director could possibly attend. A behavioral health program could apply to many social services areas including youth program, school, family services, and HR departments.
Motion by Delonda Pushetonequa to approve Apollo Davenport and a Tribal Council delegation to attend the National Tribal Health Conference in Oklahoma City on September 17-20, 2018. Harvey Davenport seconded. Vote: 5 yes, 0 no. Motion carried.
